    Terms of Service

    These Terms of Service ("Terms") govern your access to and use of ak7scooters.ae, purchases made from AK7 online or at our showroom, and repair or workshop services supplied by AK7.

    AK7 is operated by Al Akhwan Al Sabaa Used Electrical Devices Trading Est. ("AK7", "we", "us" or "our"). By using our website, placing an order, purchasing a product, booking a repair or authorising workshop work, you agree to these Terms and any additional written terms shown on an invoice, quotation, repair order, warranty card or product listing.

    Nothing in these Terms excludes or restricts any right or remedy that cannot lawfully be excluded under the laws of the United Arab Emirates.

    1. Eligibility and Customer Responsibility

    You must be legally capable of entering into a binding contract to place an order or authorise paid services. If a product is intended for a child or minor, the purchase and all related decisions must be made by a parent, legal guardian or responsible adult.

    You agree to provide accurate, complete and current contact, billing, delivery and payment information. You are responsible for protecting your account details and for activity carried out through your account.

    2. Products and Product Information

    We aim to present product descriptions, photographs, specifications, availability and prices accurately. However:

    • Product colours and appearance may vary because of lighting, screens, production batches or prior use.
    • Manufacturers may update specifications, components, packaging or accessories without notice.
    • Measurements, speed, range, runtime, load capacity and charging time may be approximate and can vary according to rider weight, terrain, temperature, tyre pressure, battery condition, riding style, settings and other conditions.
    • Images may show optional accessories or features that are not included unless expressly stated.

    Customers should confirm any feature that is essential to their purchase before ordering. A genuine correction of an obvious website error does not remove any mandatory consumer right.

    3. New, Used and Second-Hand Products

    AK7 sells both new and used products. The product condition and applicable warranty will be identified in the listing, invoice, warranty card or sales record.

    Used products may show signs of prior ownership, wear, repair or replacement parts. Customers purchasing in store are encouraged to inspect and test a used product before completing the purchase. Any known material fault should be disclosed where applicable.

    A disclosed condition, cosmetic mark or fault that the customer accepted before purchase is not treated as an undisclosed defect. This does not limit rights relating to a materially different or undisclosed condition under applicable UAE law.

    4. Orders and Contract Formation

    Submitting an online order is an offer to purchase. An automated order receipt does not by itself mean that AK7 has accepted the order.

    An online order is accepted only after:

    1. Payment has been successfully received or authorised; and
    2. AK7 has reviewed and expressly confirmed the order.

    We may decline or cancel an order before acceptance because of stock unavailability, a pricing or description error, suspected fraud, payment failure, delivery restrictions or another reasonable operational or legal reason. If payment has already been collected for an order we do not accept, the collected amount will be refunded to the original payment method.

    We may limit quantities where reasonably necessary, including for scarce products, suspected resale activity, pricing errors or promotional stock.

    5. Prices and Payment

    Prices are displayed in UAE dirhams unless stated otherwise. The price charged will be the price confirmed during checkout or stated on the accepted invoice, together with any separately disclosed delivery, assembly, service or other agreed charge.

    Payment must be made using an accepted payment method. The customer confirms that they are authorised to use the selected payment method.

    We may correct an obvious pricing error before accepting an order. If an order has already been accepted, we will handle any correction in accordance with applicable law and will not impose an undisclosed additional charge.

    6. Deposits and Special Orders

    A deposit or advance payment for a special-order product is refundable until AK7 places or confirms the corresponding order with the supplier.

    Once AK7 has placed or confirmed the supplier order, the deposit becomes non-refundable because AK7 has committed to sourcing the product, except where:

    • AK7 cannot supply the agreed product;
    • AK7 agrees otherwise in writing; or
    • A refund is required by applicable UAE law.

    Before accepting a deposit, AK7 may provide the product details, estimated price, expected timing and any special conditions in writing. Supplier and shipping timeframes are estimates unless expressly guaranteed.

    7. Availability, Delays and Substitutions

    All products are subject to availability. We will not substitute a materially different product without the customer's agreement.

    Delivery, supplier and repair completion dates are estimates unless AK7 expressly confirms a guaranteed date in writing. Delays may occur because of customs, transport, supplier availability, parts availability, payment verification, weather, government action or events outside our reasonable control.

    If a material delay occurs, AK7 will provide reasonable updates and any remedy required by applicable law.

    8. Delivery and Collection

    Delivery areas, charges, estimated timeframes, inspection requirements and collection arrangements are described in the AK7 Shipping Policy or confirmed in writing for the relevant order.

    The customer must provide a complete and accessible delivery address and a contact person who can receive the product. Additional costs caused by an incorrect address, failed delivery, restricted access or an unavailable recipient may be charged where they were reasonably incurred and disclosed.

    Customers should inspect delivered products promptly and report any incorrect item, missing component or visible transport damage as soon as reasonably possible.

    9. Returns and Refunds

    Change-of-mind exchanges, exclusions, transport costs and refund procedures are governed by the AK7 Return and Refund Policy.

    For eligible new products, customers may request a change-of-mind exchange within three calendar days after delivery or showroom collection. Products must remain unopened, unused and unassembled, with their original seals, packaging and supplied accessories intact. Products opened or assembled by AK7 during free setup are not eligible. Used products, clearance/final-sale products, products sold with a disclosed fault, special/custom orders, spare parts and electrical components are excluded.

    Change-of-mind requests qualify for exchange only, not a refund. Customers pay return and replacement delivery costs. A higher-priced replacement requires payment of the difference; a lower-priced replacement results in store credit for the difference, not a refund.

    Where a refund is otherwise approved or legally required, it is issued through the original payment method, subject to mandatory legal requirements. Online payments are not refunded as cash in-store. Suspected fraudulent transactions or refund claims may be reported to the relevant authorities.

    The three-day limit and unopened-item requirements apply only to voluntary change-of-mind exchanges. Defective-product and other mandatory remedies are assessed under the Return and Refund Policy, Warranty Policy, these Terms and applicable UAE law, and are not restricted by the change-of-mind conditions. The revised exchange terms do not retrospectively remove rights agreed for earlier purchases.

    10. Product Warranty

    The commercial warranty applying to a product will be stated on its invoice, warranty card, listing or other written sales record. Warranty coverage varies by product and may include 30 days, 3 months, 6 months or 12 months of motor-and-battery coverage.

    Used products are normally sold either without a commercial warranty or with a 7-day battery-only warranty, as recorded at the time of sale.

    Warranty coverage, exclusions and claims are governed by the separate AK7 Warranty Policy. AK7's standard warranty remedy is inspection and repair where appropriate. Any mandatory right or remedy available under UAE law remains unaffected.

    11. Product Safety and Lawful Use

    Electric scooters, dirt bikes, quad bikes, petrol vehicles and similar products can cause serious injury, property damage or death if used improperly. The customer and rider are responsible for:

    • Reading and following all operating, charging, maintenance and safety instructions.
    • Using suitable protective equipment, including an appropriate helmet.
    • Observing the stated age, rider-weight and product-use limits.
    • Providing responsible adult supervision where appropriate.
    • Checking brakes, tyres, steering, fasteners and overall condition before use.
    • Keeping batteries and chargers away from water, excessive heat, physical damage and unsuitable charging conditions.
    • Complying with all registration, licensing, traffic, location and use restrictions.

    Some products are designed only for off-road use or use on private property and may not be lawful on public roads, footpaths or cycle paths. Product capability does not mean that use is legal in every location. The customer is responsible for confirming and following the rules that apply where the product will be used.

    Do not modify, speed-unlock, reprogram or alter a product in a way that affects safety, legality or warranty coverage. AK7 is not responsible for loss or damage caused by unauthorised modification, unlawful use, racing, stunts, overloading, reckless use or failure to follow safety instructions, except to the extent responsibility cannot lawfully be excluded.

    12. Workshop Repairs and Servicing

    The following terms apply when AK7 accepts a product for inspection, diagnosis, repair, maintenance or installation work.

    Workshop assessment and transport

    Inspection, testing and repairs are carried out by AK7's technicians at our Sharjah workshop. Customers must bring or arrange delivery of the product and collect or arrange its return after the work is complete, unless another arrangement is agreed.

    Customers are responsible for transport costs both ways, including during a commercial warranty period, unless AK7 agrees otherwise or applicable UAE law requires AK7 to bear those costs. If AK7 agrees to arrange pickup and redelivery at the customer's request, the quoted transport charges must be communicated and agreed before booking.

    Standard workshop and warranty services do not include home visits or on-site repairs unless expressly agreed in writing or required by applicable law. These transport terms do not restrict mandatory consumer rights.

    Inspection and estimates

    An initial quotation or estimate may be based on the customer's description and the condition visible before disassembly or testing. Additional faults or required parts may become apparent during diagnosis or repair.

    AK7 will seek customer approval before carrying out material additional work that increases the agreed price. Approval may be given in writing, electronically, by email or through WhatsApp.

    A diagnostic or inspection fee may apply if it is disclosed before the service is performed. If the customer declines a recommended repair, charges already authorised for diagnosis, labour, disassembly, reassembly or ordered parts remain payable.

    Parts and special orders

    Repairs are subject to suitable parts being available. A deposit for a special-order part is refundable until AK7 places the supplier order. Once the supplier order is placed, the deposit is non-refundable except where AK7 cannot supply the part, agrees otherwise in writing or applicable law requires a refund.

    Replacement parts may be original, compatible, new or used, depending on availability and what the customer authorises. AK7 will not knowingly substitute a materially different part without approval.

    Existing condition and undisclosed faults

    The customer must disclose known water exposure, accidents, wiring changes, controller or firmware changes, previous repairs, performance modifications and other information that may affect diagnosis or safe repair.

    AK7 is not responsible for a pre-existing defect, hidden damage or failure caused by an unauthorised modification that could not reasonably be identified before work began, except where the loss results from AK7's negligence or where responsibility cannot legally be excluded.

    Testing and authorisation

    The customer authorises AK7 to perform reasonable diagnostic testing, bench testing and controlled test riding where necessary to inspect or verify the repair. AK7 will take reasonable care of the product while it is in our possession.

    Completion, payment and collection

    AK7 will notify the customer when work is complete or when further approval is required. Unless another arrangement is agreed in writing, all outstanding charges must be paid before the product is released.

    The customer should collect the product within a reasonable period after notification. Any storage fee must be communicated before it is charged. AK7 will not dispose of or permanently retain an uncollected product except through a process permitted by applicable law.

    Repair warranty

    Any warranty applying to workshop labour or replacement parts will be stated on the repair invoice or service record. A repair warranty does not cover a different fault, normal wear, customer-supplied parts, misuse, water damage, accident damage or unauthorised modification unless confirmed otherwise in writing.

    13. Customer-Supplied Parts

    AK7 may refuse to install a customer-supplied part if it appears unsuitable, unsafe, incompatible or unlawful. If AK7 agrees to install it, the customer remains responsible for the part's quality, compatibility and manufacturer warranty.

    Unless required by law or caused by AK7's workmanship, AK7 does not warrant a customer-supplied part or damage directly caused by its defect or incompatibility.

    14. Prohibited Use of the Website

    You must not use the website or Services to:

    • Break any law or infringe another person's rights.
    • Submit false, misleading, fraudulent or harmful information.
    • Introduce malware, interfere with security or attempt unauthorised access.
    • Scrape, copy or exploit website content or data without permission.
    • Abuse promotions, payment systems, returns or customer accounts.
    • Harass staff, customers or other users.

    We may suspend access, cancel an unaccepted order or report unlawful conduct where reasonably necessary.

    15. Intellectual Property

    The website and its content, including the AK7 name, branding, text, images, graphics, videos, product presentation and website design, are owned by or licensed to AK7 and are protected by applicable intellectual-property laws.

    You may use the website for personal shopping and information purposes. You may not reproduce, modify, distribute, sell or commercially exploit protected content without written permission.

    Third-party product names and trademarks belong to their respective owners. Their appearance on our website does not imply ownership by AK7.

    16. Third-Party Services and Links

    Our website uses Shopify and may connect to payment, delivery, analytics, advertising, social-media and communications services operated by third parties. Your use of a third-party service may also be governed by that provider's terms and privacy policy.

    AK7 is not responsible for an independent third-party website or service that we do not control, except where applicable law provides otherwise.

    17. Privacy

    Personal information is handled according to the AK7 Privacy Policy. By using the Services, you acknowledge that online-store and service providers, including Shopify, may process information required to provide the Services.

    18. Service Availability

    We aim to keep the website available and accurate, but we do not guarantee uninterrupted, error-free or secure access at all times. We may update, suspend or withdraw website features for maintenance, security, legal or operational reasons.

    19. Limitation of Liability

    To the maximum extent permitted by law, AK7 is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by unlawful use, misuse, unauthorised modification, failure to maintain a product or failure to follow instructions.

    Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory consumer obligations, or any liability that cannot lawfully be excluded or limited.

    20. Changes to These Terms

    We may update these Terms to reflect changes to our business, Services, policies or legal obligations. The revised Terms will be posted with an updated revision date.

    The Terms applying to a completed purchase or accepted repair are generally those in effect when the order or service was accepted, together with any written terms recorded for that transaction, unless a later change is required by law or agreed with the customer.

    21. Severability and No Waiver

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

    If AK7 does not immediately enforce a provision, this does not waive the right to enforce it later.

    22. Governing Law and Disputes

    These Terms and transactions with AK7 are governed by the applicable laws of the United Arab Emirates.

    The parties should first attempt to resolve any complaint directly and in good faith. Subject to any mandatory consumer complaint process or jurisdiction, disputes will be submitted to the competent courts of Sharjah, United Arab Emirates.
